I-751 Form Overview

USCIS Form I-751, Petition to Remove Conditions of Residence is the form designated for use in petitioning for the removal of conditions on permanent residency. Form I-751 is 11 pages long and consists of 11 parts. It is available for download on the USCIS website here. The USCIS will also mail individuals the I-751 form by request, which is available on the USCIS website here. Since the request is made online and the form is also available online, it is far more convenient to just download the form from the USCIS website. The downloadable .PDF form is fillable through various programs. Alternatively, the form may be printed and handwritten in black ink.

When completing the I-751, it is important to remember:

• Type or print legibly in black ink.
• Use the most current form version.
• The USCIS prefers that you download the I-751 from its website, complete it electronically, and then print your forms to submit.
• Don’t forget to sign the form! This part cannot be done electronically.
• Do not use highlighters, white-out, or other correction fluid or tape. If you make an error, print out a clean form.
• Stamped or typewritten names in place of actual signatures are not acceptable.

This section mostly requests basic, general information about you. It is, for the most part, self-explanatory.

This question is asking about an account established for using the USCIS online filing system (formerly known as the USCIS Electronic Immigration System or USCIS ELIS). It is not the same as an Alien Registration Number. If you’ve had to pay the USCIS online for the Immigrant Fee, you should have an account number.

10. Enter your current marital status as either Single, Married, Divorced, or Widowed.

11. Date of Marriage (mm/dd/yyyy).

12. Place of Marriage. If your marriage took place in the United States, provide the city and state. If your marriage took place outside the United States, provide the city, state, and country.

13. If the marriage through which you gained conditional residence has ended, provide the date it ended (date of divorce or date of death) (mm/dd/yyyy).

14. Conditional Residence Expires On (mm/dd/yyyy). This date is noted on your green card.

16. Is your physical address different than your mailing address? Do not forget to check yes or no.

If you answer “Yes” to Item Number 16, you’ll need to provide your physical address in Item Numbers 17. a. – f.

19. Was a fee paid to anyone other than an attorney in connection with this petition? If you answer “Yes” to this question, the person that helped prepare the form should complete Part 10 and sign it.

20. Have you ever been arrested, detained, charged, indicted, fined, or imprisoned for breaking or violating any law or ordinance (excluding traffic regulations), or committed any crime which you were not arrested in the United States or abroad? The first part of this question is straight forward. It asks about criminal activity where records most likely exist. The second part, however, asks about criminal activity that you could have been arrested for, but were not arrested for whatever reason. If you believe you should answer “Yes” based on the second part of this question, consider consulting with a criminal lawyer to assess the potential criminality of the conduct in question.

If you answer “Yes” to this question you will need to use Part 11 to provide a detailed explanation. You will also need to include additional evidence with your I-751 petition regarding the criminal conduct.

22. Have you resided at any other address since you became a permanent resident? If you answer “Yes” to this question, be prepared to list all the addresses and corresponding dates for the places where you have resided since becoming a permanent resident.

23. Is your spouse or parent’s spouse currently serving with or employed by the U.S. Government and serving outside the United States?

Part 2. Biographic Information

1. Ethnicity (Hispanic or Latino). According to the USCIS, “Hispanic or Latino” means a person of Cuban, Mexican, Puerto Rican, South or Central American, or other Spanish culture or origin, regardless of race.

2. Race (Select all applicable boxes). The USCIS applies the following definitions for each listed Race:

White: A person having origins in any of the original peoples of Europe, the Middle East, or North Africa.

Asian: A person having origins in any of the original peoples of the Far East, Southeast Asia, or the Indian subcontinent including, for example, Cambodia, China, India, Japan, Korea, Malaysia, Pakistan, the Philippine Islands, Thailand, and Vietnam.

Black or African American: A person having origins in any of the black racial groups of Africa.

American Indian or Alaska Native: A person having origins in any of the original peoples of North and South America (including Central America), and who maintains tribal affiliation or community attachment.

Native Hawaiian or Other Pacific Islander: A person having origins in any of the original peoples of Hawaii, Guam, Samoa, or other Pacific Islands.

Note: If you selected “Hispanic or Latino” as your Ethnicity, you may not need to select a Race (unless one or more are applicable to your origins).

4. Weight. In pounds.

5. Eye Color (Select only one box).

Part 3. Basis for Petition

This part of the I-751 form is brief. It only asks one question: the basis for the petition. The question, however, is a critical one. If you’re jointly filing the I-751 petition, Item Number 1. a. or 1. b. is applicable. If you’re filing individually, you will need to check one or more of the boxes in Item Numbers 1. c., 1. d., 1. e., 1. f., or 1. g.M.

Part 4. Information About the U.S. Citizen or Lawful Permanent Resident Spouse. If Filing as a Child Separately, Information About the U.S. Citizen or Lawful Permanent Resident Stepparent Through Whom You Gained Your Conditional Residence

Part 5. Information About Your Children

In this section you will include information about your children.

For each child, you will mark whether or not the child is “applying with you” at the bottom of each “Child” section. A child could be “applying with you” if they received a two-year conditional green card as the same time you did or within 90 days of when you received your green card. If you mark “No”, but your child has a two-year conditional green card and wants the conditions on residence removed, he or she will need to file a separate I-751.

Part 6. Accommodations for Individuals With Disabilities and/or Impairments

In this section, you can requests accommodations for your I-751 interview due to the disabilities and/or impairments of your spouse, your child(-ren), or yourself. If you mark “Yes” to the questions, you will need to provide the USCIS with information in Item Numbers 4. a. – 4. c. The USCIS will provide “reasonable accommodations” that vary with each disability and/or impairment. Examples of “reasonable accommodations” may include the presence of a sign-language interpreter for the deaf or hard of hearing or an in-hospital visit for the incapacitated.

Wheelchair Users: As all domestic USCIS facilities meet the Accessibility Guidelines of the Americans with Disabilities Act, wheelchair users do not need to request an accommodation for physical access to a domestic USCIS office. Nevertheless, wheelchair users may indicate use of a wheelchair in Part 6. The USCIS instructs that this will allow better preparation for your visit.

Part 7. Petitioner’s Statement, Contact Information, Acknowledgment of Appointment at USCIS Support Center, Certification, and Signature.

This section must be read (or interpreted to) and signed by the Petitioner (i.e. the Conditional Resident). If you had an interpreter, the interpreter must complete Part 9. If you had someone help you prepare the I-751, you must note it in Item Number 2 and have them complete Part 10. Do not forget to type or write your name in the acknowledgment, to sign at Item Number 6. a., and to put the date in Item Number 6. b.
